• engaged in discrimination with its policy of detaining people based on race, color and/or ethnicity;
• violated the Fourth Amendment guarantee against unreasonable search and seizures;
• violated the plaintiff's Montana constitutional rights; and

Illegal entry into the United States is not a criminal offense. However, if a person has been previously deported, illegal reentry then does become a criminal offense, and can lead to a lengthy federal prison sentence.
